TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions constitute a legally binding agreement made between Arifin Digital Enterprise (202603004972), a registered entity in Malaysia (hereinafter referred to as "the Enterprise"), and the Educational Institution (hereinafter referred to as "the School") utilizing the web platform mysekolah.arifin.my and the mobile applications MySekolah-eHadir and MySekolah-ePSS (collectively, "the Platform").

1. DEFINITIONS AND SCOPE

The Platform: Refers to the integrated school management system, including the web portal and mobile extensions for attendance (eHadir) and library management (ePSS).

Mother Data: Refers to the primary datasets uploaded by the School, including but not limited to eOperasi, idME, and DELIMa student/staff lists.

Tenure: A fixed twelve (12) month subscription period commencing from the date of activation.

Authorized Users: Teachers, school administrators, and staff officially recognized by the School.

2. ELIGIBILITY AND ACCOUNT GOVERNANCE

2.1 Identity Authentication: Access to the Platform is prioritized for users with official Google ID DELIMa or MyGovUC credentials. While personal email addresses are technically supported, the Enterprise disclaims liability for security vulnerabilities arising from the use of non-institutional email accounts.

2.2 Account Responsibility: The School shall ensure that access is granted only to authorized personnel. Any breach of security resulting from shared credentials or unauthorized access at the school level is the sole responsibility of the School.

3. DATA SOVEREIGNTY AND "MOTHER DATA" PROTOCOLS

3.1 Ownership: All data uploaded, generated, or stored within the Platform remains the exclusive property of the School. The Enterprise claims no ownership over the intellectual property of the School’s records.

3.2 CRUD Autonomy: The School maintains absolute autonomy over Create, Read, Update, and Delete (CRUD) functions via the front-end interface.

3.3 Back-end Access & Integrity:

  • The Enterprise serves as the Data Processor and maintains back-end access for system optimization and maintenance.
  • The Enterprise shall not execute any data modifications, overrides, or deletions directly via the back-end without a formal, written request from the School’s administration.
  • The Enterprise reserves the final discretion to approve or deny back-end modification requests if such actions are deemed to jeopardize the structural integrity of the Platform’s database.

4. DATA PRIVACY AND THIRD-PARTY DISCLOSURE

4.1 PDPA Compliance: The Enterprise warrants that all data processing activities align with the Personal Data Protection Act (PDPA) 2010.

4.2 Confidentiality: No student, teacher, or institutional data shall be disclosed to any third party (including commercial entities or external agencies) without the explicit formal authorization of the School.

4.3 Reporting: The Platform provides tools for report generation. However, the Enterprise does not automatically transmit data to PPD or JPN. All external reporting and data sharing are the manual and intentional acts of the School.

5. SUBSCRIPTION, PRICING, AND CESSATION OF SERVICE

5.1 Tiered Pricing: Annual fees are calculated based on the total student enrollment:

  • 0 – 300 Students: RM 188.00
  • 301 – 800 Students: RM 288.00
  • 801 – 1,200 Students: RM 388.00
  • Exceeding 1,200 Students: Custom pricing via formal consultation.

5.2 Payment Terms: Payments must be rendered via Bank Transfer or QR to ARIFIN DIGITAL ENTERPRISE (OCBC Al-Amin Bank).

5.3 Renewal & Suspension: Failure to settle renewal fees prior to the expiration of the 12-month tenure will result in the immediate automatic cessation of access to the web platform and mobile applications. The Enterprise is not liable for data inaccessible during a period of suspension due to non-payment.

6. LIMITATION OF LIABILITY AND INDEMNITY

6.1 Administrative Decisions: The Enterprise provides a data-management tool. We are not liable for any disciplinary, pedagogical, or administrative actions taken by the School, PPD, or JPN based on reports generated by the Platform.

6.2 Accuracy of Input: The School is solely responsible for the accuracy, legality, and integrity of the data inputted into the system. The Enterprise shall not be held liable for errors arising from incorrect data entry by School staff.

6.3 Force Majeure: The Enterprise shall not be liable for any failure to perform its obligations where such failure results from any cause beyond the Enterprise’s reasonable control, including internet outages, server host failures, or government interventions.

7. INTELLECTUAL PROPERTY RIGHTS

The software architecture, source code, UI/UX design, and brand marks (MySekolah-eHadir, MySekolah-ePSS) are the exclusive property of Arifin Digital Enterprise. Unauthorized reverse-engineering, duplication, or redistribution of the Platform’s code is strictly prohibited and subject to legal action under Malaysian Law.

8. AMENDMENTS AND GOVERNING LAW

8.1 Amendments: The Enterprise reserves the right to modify these Terms at any time. Continued use of the Platform following such changes constitutes acceptance of the new Terms.

8.2 Jurisdiction: This Agreement shall be governed by and construed in accordance with the Laws of Malaysia. Any disputes shall be submitted to the exclusive jurisdiction of the Malaysian Courts.

Acceptance

By proceeding with the subscription and payment to Arifin Digital Enterprise, the School acknowledges that it has read, understood, and agreed to be bound by these Terms and Conditions.
